By submitting UGC, you grant us an irrevocable, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display such content in connection with the Game. You represent that you own or have permissions to all submitted content and that it does not violate any third-party rights or applicable laws.
The Game may be distributed via app stores (such as Google Play or other platforms), and your use may also be subject to their respective terms. Additionally, Earth2037 may contain links to external websites or services that are not owned or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of such third-party services.
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME FULL RESPONSIBILITY FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM USE OF THE GAME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EARTH2037 DEVELOPER, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE GAME; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (iii) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US DIRECTLY FOR THE GAME (IF ANY) DURING THE SIX MONTHS PRIOR TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Earth2037 and its developers, suppliers, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Game; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit to the Game.
We may suspend or terminate your access to the Game immediately, without prior notice or liability, for any reason whatsoever including without limitation if you breach these Terms. Upon termination, your right to use the Game will cease immediately. Sections regarding intellectual property, indemnification, limitation of liability, and dispute resolution shall survive termination.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where the developer resides (without regard to conflict of law principles). Any dispute arising from or relating to the Game or these Terms shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration institution. You agree that any claim you may have must be filed within one (1) year after it arose, or it will be forever barred.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
